Pension Splitting On Change in Marital Status

I think the program may be incorrect in determining the eligible pension splitting amount in the case where a couple who were living common-law become married during the year. The program prorates the number of months on the T1032 based on the number of months that the spouses were "married" but the form clearly states that it should be the number of months that the couple were married or living common-law. I got around this by changing the date of marital status change to January 1 but Profile might want to note this for next year.

In this situation, Profile only recognizes the marital status indicated on the "info" from as of December 31, 2010, and when the date of change occurred for purposes of this calculation. It does not have the information on what the taxpayer's marital status was prior to the change.

For existing clients, I think it would be reasonable to add a carryforward element so that Profile captures the marital status as of January 1, 201X from your prior year return in the background (in your case, "common-law") to provide us with the missing piece of information for purposes of that calculation.

I'll document this item within our system for potential future inclusion.
